Although most of the provisions of SB 1070 have been enjoined by the courts, the U.S. Supreme Court allowed Section 2B or the “show me your papers” provision, to go into effect. However, the Court stated that this section could be found to violate the Constitution based on evidence that it was improperly applied once in effect.
Section 2B requires the police to ask someone they have already stopped about their immigration status if they have a reasonable suspicion that the person may be undocumented. The law clearly invites racial profiling and other abuses that are unjust, un-American, and unconstitutional.
